What you need to know for 2021 Property Tax season

It’s that time again…Property Tax season!  Bills are coming due across many counties and cities across metro Atlanta and if you’re preparing to buy or sell a house, here is some information you need to know as you get ready for your upcoming closing.

Who is responsible for paying the tax bill once FINAL TAX BILLS are sent out by the county? 

The closing attorney MUST collect at the closing table and then remit payment to the proper taxing authority.  This will show as debit on the Seller’s side of the ALTA/Settlement Statement.

Does the Buyer have to pay anything once final bills are out?

Yes, the closing attorney will collect from the Buyer the prorated amount which begins on the purchase date through the end of the year.  This will reflect as a credit to the Seller.

I bought early in 2021 and when my final tax bill arrived it was significantly higher then what was collected for, can I ask the Seller for his portion?

It depends.  If you bought from and iBuyer, like Zillow or OpenDoor, or a relocation company, then unfortunately no.  In your Acknowledgement and Receipt of Settlement Statement there was language that states:

Buyer and Seller agree that the proration used herein is correct as of the date of this closing and further agree that there shall be NO reproration based on any actual bill or reassessments received after the date of closing. The payment of all outstanding property taxes and assessments not paid at settlement are the responsibility of the Buyer.

However, if you bought in the standard way where both a Buyer and Seller were present, then yes you can ask the Seller to remit payment for his/her prorated for portion.  You will also see that language in the Acknowledgement and Receipt of the Settlement Statement:

Buyer and Seller agree to adjust said prorations based on the ACTUAL BASE AMOUNT DUE between themselves after closing and to immediately remit to the other the funds to make said proration correct.

  • City of Marietta
  • Dekalb County
  • Fayette County
  • Forsyth County
  • Fulton County
  • Gwinnett County
  • Habersham County
  • Henry County
  • Paulding County
  • Walton County
